Terms and Conditions

  1. The Kubota Golden Opportunity Competition ("Competition") is conducted by Kubota Australia Pty Ltd, ABN 72 005 300 621, 25-29 Permas Way, Truganina, Victoria 3029 ("Promoter") and is governed by these Terms and Conditions ("Conditions").
  2. Information on how to enter and the details of the Competition form part of the Conditions. Entry into the Competition is deemed acceptance of the Conditions.
  3. Entry is restricted to Australian residents aged 18 years and over ("Eligible Entrants"). Employees of the Promoter are ineligible to enter.
  4. The Competition commences on October 1, 2018 and will close at a time to be decided by the Promoter ("Competition Period"). The Promoter will announce the closing time on the Golden Opportunity Website (defined below) by giving no less than 3 months' notice ("Closing Date Announcement").
  5. For every new product purchased before close of business on the day of the Closing Date Announcement, customers will be sent a Kubota pack ("Welcome Pack") via post to an address nominated at the time of purchase. Each Welcome Pack will include a golden ticket, which will show the website link that Eligible Entrants will need to visit to enter the Competition ("Golden Opportunity Website").
  6. Eligible Entrants must enter the code shown on their golden ticket on the Golden Opportunity Website. To enter the Competition, Eligible Entrants must explain in 25 words or less what they love about their new Kubota product.
  7. Eligible Entrants may submit an entry for each golden ticket that they receive.
  8. Entries must be completed in English to be eligible. Entries that the Promoter considers to be incomplete, incomprehensible or contain defamatory or offensive content will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
  9. Entries must be received during the Competition Period. Entries received by the Promoter will be considered final. Entries are deemed to be received at the time they are received on the Promoter's database and not at the time of submission by the Eligible Entrant.
  10. The Promoter reserves the right in its sole discretion to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions.
  11. The Promoter is not responsible for technical difficulties with the Golden Opportunity Website and does not warrant that the Golden Opportunity Website will be functional at all times during the Promotion.
  12. If the Competition is not able to run as planned due to technical difficulties or interference beyond the Promoter's reasonable control, then the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition and/or invalidate any entries.
  13. This is a game of skill. Chance plays no part in determining winners. All entries will be reviewed and judged by the Promoter based on selected criteria including, but not limited to, originality, creativity and brand suitability.
  14. A winner will be chosen for each month of the Competition Period. Winners will be notified via email or text message on the second Friday of the following month. Winners will also be listed on the Golden Opportunity Website.
  15. Entries will only be considered for the month that they are received and unsuccessful entries will not be considered in subsequent months.
  16. The Promoter's decisions are final and no correspondence will be entered into.
  17. The prize for each winner will be a $1,000.00 EFTPOS card ("Prize"). The Promoter will deliver the Prize by post to the winner's nominated address. The Prize can be used anywhere in Australia where EFTPOS is accepted. The Prize is subject to the Promoter's conditions, including validity periods.
  18. The Promoter is not liable for and will not provide any replacement prize if the Prize is lost, stolen, forged, damaged or tampered with in any way once posted or if the Prize is not activated or used before the stated expiry date.
  19. Winners may use the Prize to transfer funds to other persons. The Promoter is not liable for any issues arising from the transfer of funds to other persons, and so will not provide any replacement prize for any such issues.
  20. All entries become the property of the Promoter. Entrants can request access to the personal information the Promoter holds about them by contacting Laura Osswald on laura.osswald@kubota.com. By entering the Competition, entrants consent to their personal information being stored on the Promoter's database and the Promoter may use this information to contact entrants about special offers and deals, news, and information about its products. If entrants do not provide their personal information, the Promoter will not be able to enter that entrant in the Competition. The Promoter's privacy policy is available on its website at https://kubota.com.au/privacy-policy/.
  21. The Promoter may advertise the Competition using Facebook and/or Instagram. The Competition, however, is in no way sponsored, endorsed or administered by, or associated with, Facebook and Instagram. Entrants are providing their information to the Promoter, and not to Facebook and Instagram. Each entrant completely releases Facebook and Instagram from any and all liability.
